A jury found appellant Terry Pennycuff guilty on two counts of incest, three counts of child molesting, and one count of sexual misconduct with a minor for carrying on a sexual relationship with his teenage daughter over a three-year period. The Court of Appeals ordered a new trial, holding that Pennycuff's lawyer was ineffective for failing to object to evidence that violated Pennycuff's rights under Doyle v. Ohio.
