This cause is before the Court upon Defendants' Motion to Dismiss.1 Upon consideration of the motion and opposition, the Court enters the following Order.

I. Background

This case stems from the custody dispute over six-year old Elian Gonzalez between his father Juan Miguel, a Cuban National, and his great-uncle Lazaro Gonzalez, an American citizen.
