This matter is before the Court on the Appeal of Estes, a motor carrier, from the district court's order granting a directed verdict in favor of Siren, the shipper, in the amount of $46,982.16. The issue on appeal is whether the parties agreed in writing to limit the liability of Estes in accordance with 49 U.S.C. § 14706(c)(1)(A). We conclude the parties did make such an agreement, and Estes' liability is limited to $8,309.00. Accordingly...
