EDWARDS, Judge.

Defendant, Aaron P. Richardson, was convicted of aggravated battery, a violation of LSA-R.S. 14:34, and sentenced to ten years of imprisonment at hard labor. On appeal, this court affirmed the conviction, but on patent error review, discovered that the trial court had immediately sentenced Richardson after denying his motion for new trial without obtaining a waiver of statutory delays. Consequently we vacated the sentence and remanded for re-sentencing...
