Petitioner-Appellee Wendell Locke, a state prisoner, filed a petition for a writ of habeas corpus on August 24, 1998. The government responded with a motion to dismiss on the ground that Mr. Locke's petition was time barred pursuant to 28 U.S.C. § 2244(d)(1)(A).
