WILLIAMS, J.

The state charged the defendant, Thomas Geer, Jr., with burglary of an inhabited dwelling, but agreed not to file a habitual offender bill and to reduce the charge to simple burglary in exchange for defendant's guilty plea to the amended charge, a violation of LSA R.S. 14:62 punishable by no more than 12 years imprisonment at hard labor. The district court sentenced defendant to serve five years at hard labor and denied a timely motion for reconsideration...
