The defendant, Linnette Marie Brice, was charged by grand jury indictment with one count of manslaughter, a violation of La. R.S. 14:31. She pled not guilty and, following a jury trial, she was found guilty as charged by unanimous verdict. The defendant moved for a new trial and post-verdict judgment of acquittal, but the motions were denied. She was subsequently sentenced to ten years at hard labor.
