This is a case brought pursuant to 42 U.S.C. § 1981, in which Larry D. Hysten, the plaintiff, alleges that the Burlington Northern and Santa Fe Railroad Co., the defendant, discriminated against him on the basis of his race by suspending him from work and disciplining him.
