The defendant, Michael Lovick, along with Johnas Durall, was charged by grand jury indictment with first degree murder in violation of La. R.S. 14:30. Thereafter, on defendant's motion, the cases were severed for trial. Defendant was convicted of second degree murder, and sentenced to the mandatory penalty of life imprisonment at hard labor, without benefit of parole, probation or suspension of sentence.
