¶ 1 The Commonwealth appeals from the September 18, 2000 judgment of sentence of one (1) to two (2) years', less one day, imprisonment plus three (3) years' probation imposed after appellee, Richard Benn, entered an open plea of guilty to one count each of the summary offenses of driving while under suspension1 and failure to give information and render aid in an accident involving death or personal injury,
