The appellant, Melvin Douglas Smith, Jr., was tried on four counts of murder and four counts of use of a firearm in the commission of murder. On September 24, 1999, a jury in the Circuit Court of the City of Richmond found appellant guilty of first degree murder of only one of the victims, Kenneth "Randy" Smith, and of use of a firearm in the commission of that murder. The jury sentenced appellant to prison terms of fifty-five years for the murder...
