This is a capital case. On January 10, 1994, an Ouachita Parish grand jury indicted the defendant, Jimmie Christian Duncan, for first degree murder in violation of La.Rev.Stat. 14:30. On April 7, 1998, a jury found defendant guilty as charged and, after a sentencing hearing, unanimously recommended the death sentence.
