On February 13, 1997, pursuant to a plea agreement, appellant Thomas Calmes pleaded guilty to second-degree criminal sexual conduct in violation of Minn.Stat. § 609.343, subd. 1(d) (2000), and first-degree burglary in violation of Minn.Stat. § 609.582, subd. 1(c) (2000). In return, the state agreed that Calmes would receive the presumptive sentence under the sentencing guidelines...
