Defendant, Edmond D. Spencer, was charged by grand jury indictment with first degree murder, a violation of LSA-R.S. 14:30. He pled not guilty. After a trial, the judge declared a mistrial based upon the jury's inability to render a verdict. Subsequently, the state amended the indictment and charged defendant with second degree murder, a violation of LSA-R.S. 14:30.1. Defendant was arraigned on this charge...
