This matter is before the Court on Defendant's motion for summary judgment. Plaintiff, Timothy Phillips ("Phillips"), claims that Defendant, Swift & Co. ("Swift"), breached its fiduciary duty to him with regard to its treatment of an injury he received on the job and his resulting work restrictions. In its motion for summary judgment, Swift argues that it did not breach any fiduciary duty to Phillips...
