This appeal presents primarily two issues: (1) Whether there is a genuine issue of material fact concerning an alleged breach of the implied covenant of good faith and fair dealing by the City of Wilmington and (2) whether a federal court's dismissal of due process claims bars the relitigation of identical claims in Delaware courts under the doctrine of res judicata.
