This matter comes before the Court on Defendant's Motion to Dismiss Indictment Based on Destruction of Evidence (# 89). Defendant is charged in Count 2 of a Superseding Indictment with manufacturing methamphetamine. The government has filed a Notice of Enhanced Penalties based on drug quantity and Defendant's prior criminal history.
