Defendant, Milton L. Livas, Jr. (Livas), was charged by bill of information with possession of cocaine, a violation of La. R.S. 40:967C. Defendant pled not guilty and, after a jury trial, was found guilty as charged. Defendant filed motions for new trial and post-verdict judgment of acquittal, which were denied. After the appropriate sentencing delays, the trial court sentenced defendant to three years at hard labor, to run concurrent with the sentences...
