In 1993, plaintiffs Joey Simpson and his wife, Jeannette, filed a complaint for damages against the defendants, Transus, Inc., a Georgia corporation, and its insurer, Protective Insurance Company, an Indiana corporation, for personal injuries he sustained in a truck collision and her loss of consortium. Mr. Simpson's employer at the time of the accident, appellee-plaintiff Southwire Company intervened seeking to protect and enforce its subrogation...
