Monte Dell Starchman pled guilty to one count of lewd conduct with a minor, I.C. § 18-1508, and one count of sexual battery of a minor child, I.C. § 18-1508. In exchange for those pleas, the state dismissed nine related felony counts. The district court sentenced Starchman to a determinate term of forty years for each count and ordered Starchman's sentences to run concurrent. Starchman filed an I.C.R. 35 motion, which the district court denied...
