STATE v. GILMAN

No. 19314-4-III.

19 P.3d 1116 (2001)

STATE of Washington, Appellant, v. Dustin W. GILMAN, Respondent.

Court of Appeals of Washington, Division 3, Panel One.

March 22, 2001.

Attorney(s) appearing for the Case

Kevin M. Korsmo, Deputy Pros. Atty., Spokane, for Appellant.

David N. Gasch, Spokane, for Respondent.

KATO, J.

The State charged Dustin Gilman with two counts of fourth degree assault. Finding the State had violated JuCR 7.6(e), the court dismissed the charges. The State appeals. We affirm the court's finding that the State violated the rule, but remand to determine if dismissal was the appropriate remedy.

On December 16, 1999, ten-year-old Dustin was arrested and booked into detention. He appeared in court the next day for a detention hearing.
