LEESON, J.

The sole issue on review in this civil action is whether the trial court erred in awarding attorney fees to defendant University of Oregon (University) after it had granted defendants' motion for summary judgment on all plaintiff's claims.1 The Court of Appeals affirmed the trial court's grant of summary judgment, but vacated and remanded the trial court's award of attorney fees.
