R.S.R. v. A.K.

No. 1D01-3311.

801 So.2d 325 (2001)

R.S.R., Father of T.C.R., A Child, Petitioner, v. A.K., Mother of T.C.R., A Child, Respondent.

District Court of Appeal of Florida, First District.

December 19, 2001.

Attorney(s) appearing for the Case

Robert Moeller, Cross City, for Petitioner.

Phillip K. Beck, Chiefland, for Respondent.

ERVIN, J.

We grant the petition for writ of certiorari and quash the trial court's order requiring petitioner to submit to DNA testing to determine paternity, because the trial court failed to first consider the petitioner's equitable estoppel claim or whether testing was in the child's best interest. See Marshek v. Marshek, 599 So.2d 175 (Fla. 1st DCA 1992); Barker v. Barker, 785 So.2d 1273
