I. INTRODUCTION

On August 12, 1999, Creo Products, Inc. ("Creo") filed a declaratory judgment action in which it claimed that two patents belonging to Presstek, Inc. ("Presstek"), United States Patent Nos. 5,163,368 ("the '368 patent") and 5,174,205 ("the '205 patent") are not enforceable and that it does not infringe them. Presstek filed counterclaims on September 22, 1999, and is currently arguing...
