PER CURIAM.

On the authority of Ex parte Berry, 794 So.2d 307 (Ala.2000), the judgment of the circuit court is reversed and this cause is remanded to the Elmore Circuit Court for proceedings consistent with the Supreme Court's opinion.

REVERSED AND REMANDED.
