The defendant, Richard Allison, was convicted by a jury of (1) murder in the first degree on a theory of extreme atrocity or cruelty; (2) armed robbery; and (3) perjury. The defendant filed a motion for a new trial with the county court while his appeal was pending. A single justice of this court transferred the motion to the Superior Court pursuant to G.
