The defendant is charged with aggravated harassment in the second degree (Penal Law § 240.30 [1]) and harassment in the second degree (Penal Law § 240.26 [3]). He moves to dismiss both counts as facially insufficient and on the further ground that the aggravated harassment statute is constitutionally overbroad. Defendant further moves to compel a bill of particulars and discovery, to suppress statement evidence...
