This matter originated as a tort action filed pursuant to 33 U.S.C. § 905 by an employee (Elfredroe Love) against his employer (Apex Oil Company, Inc.) for injuries sustained in the course and scope of his employment as a deckhand on the Mississippi River. After being notified by the employer's insurer that there was no longshoreman's coverage for his claim, he instituted this action seeking to recover damages in tort for the defendant/employer...
