Bethany Pharmacal Company, Inc. ("Bethany") brought this action against QVC, Inc. ("QVC"). It claimed that QVC had agreed to allow Bethany to appear on QVC's televised shopping program in order to sell its skin moisturizer. QVC moved for summary judgment.
