MEMORANDUM OPINION

ALBRITTON, Chief Judge.

I. INTRODUCTION

This cause is before the court on a Motion to Remand (Doc. # 5), filed by the Plaintiff, Donald Gregg Shaner ("Shaner"), on January 30, 2001.

Shaner originally filed his Complaint and Amended Complaint in this case in the Circuit Court of Montgomery County, Alabama. Shaner brought claims against Fleet Bank and First Select Corporation.
