MORGAN, J.

Daniel McKinnon appeals his bench trial conviction of failing to register as a sex offender. We reverse and remand for new trial.

Former RCW 9A.44.130 required a sex offender to register with the county sheriff. On May 3, 1999, Division One held that the statute did not apply while a sex offender was homeless.1 On October 29, 1999, Division Two held to the same effect.
