Circle Redmont (Circle) appeals the final judgment entered by the trial court in favor of Mercer Transportation (Mercer), arguing that the court erred in determining that Circle's state law claims based on Mercer's failure to collect C.O.D. charges on its behalf were preempted by federal law.
