Petitioner has been in prison since 1975 serving an indeterminate sentence of 25 years to life after having been convicted of murder. The conviction emanates from an incident in which petitioner and another individual sexually abused and stabbed to death a woman and her nine-year-old daughter. In May 1999, respondent denied petitioner's application for parole release. Supreme Court dismissed the CPLR article 78 proceeding to review that determination...
