The applicant, John Carillo (Carillo or applicant), convicted in 1973 of murdering a correctional officer at the Adult Correctional Institutions (ACI), appealed the denial of his application for post-conviction relief. The basis for Carillo's appeal was that his due process rights were violated because the "true" nature of a plea agreement between the state and a witness who testified against him was not disclosed.
