Ree Clay and Ruby Chivers (collectively "the plaintiffs") entered into a series of retail installment contracts and mortgages to finance home improvements provided by Davenport Construction Company ("Davenport"). Marvin Bilfeld, Davenport's owner, assigned Davenport's interest in the contracts to Iver Johnson, who became the mortgagee.
