[¶ 1] Fun Flight, LLC ("Fun Flight"), as the successor in interest to the claims of Triple Quest, Inc. ("Triple Quest"), appealed from an order dismissing, without prejudice, its damage action against Cleveland Gear Company, Inc. ("Cleveland Gear").
