Joseph Waymire, a conductor for the defendant Norfolk and Western Railway Company ("N & W"), sued his employer under the Federal Employers' Liability Act ("FELA"), 45 U.S.C. § 51 et seq., claiming that the post traumatic stress he suffered after a train/truck collision disabled him from continuing his employment. The District Court found that Waymire's FELA negligence claims were superseded by the Federal Railroad Safety Act ...
