This case arises out a suit brought by Irene Sahulka against Lucent Technologies, Inc. (Lucent), pursuant to the Employee Retirement Income Security Act (ERISA), 29 U.S.C. §§ 1001-1461, alleging that Lucent wrongfully refused to pay the plaintiff discretionary death benefits under the AT & T1 Pension Plan (Plan) following the death of her husband.
