I. INTRODUCTION

Constance Cole sold Thomas and Janet Bartels a home with decayed walls. The Bartelses sued Cole, claiming that she willfully failed to disclose the defect. Cole filed a third-party claim against carpenter Charles Bourque, alleging that he had failed to fully disclose the "wall rot" to Cole. Bourque cross-claimed on the basis that Cole never paid him for his services. A jury found against Cole...
