We vacate the Order of Final Summary Judgment without prejudice and remand for further proceedings. The grant of summary judgment was premature, as there remains to be resolved the dispute between the Kappa Group, Inc. and the Hurwitz Group as to the terms of the Hurwitz mortgage and the provisions of the Confirmation Agreement.
