This is the third appearance in this court of this action for injunctive relief and damages. Evelyn A. O'Connor filed suit in the district court for Scotts Bluff County against her rural neighbors, David A. Kaufman and Virginia L. Kaufman (the Kaufmans), claiming that she had an implied easement, arising from former use, for the maintenance of a well, pump, and pipeline located on the Kaufmans' property.
