NELDA V. RODRIGUEZ, Justice.

This is an accelerated appeal from the denial of a summary judgment based on the affirmative defense of immunity. See TEX.CIV.PRAC. & REM.CODE ANN. § 51.014(a)(5) (Vernon Supp.1999). We affirm.
