GROSS, J.

Floyd Persaud appeals his convictions of two counts of manslaughter by culpable negligence and three counts of culpable negligence. See §§ 782.07(1), 784.05(2), Fla. Stat. (1999). We affirm, and write to address one issue.

Persaud was charged along with co-defendant Joseph Conti. The state's theory of the case was that the defendants were high speed drag racing on a public street, resulting in a five car collision causing the deaths...
