In this appeal from an order denying a defendant's motion to compel arbitration, the central issue is whether the court or arbitrators should determine whether plaintiff's claims are covered by the arbitration agreement between the parties. Plaintiff argues that under NASD Rule 10304 her claim is outside the agreement to arbitrate and that the judge can properly so decide.
