Appellants sued the Texas Department of Transportation claiming that a handicap ramp on a sidewalk contained a defect causing injuries to appellant James Snow. The trial court granted a "no evidence" summary judgment to the Department of Transportation based on its claim that the alleged defect was not a special defect and that there was no evidence the Department had actual knowledge of the claimed defect prior to the incident.
