OPINION

KERRY P. FITZGERALD, Justice.

At issue in this appeal is whether it is reasonable for a police officer to arrest an individual based only on his commission of the traffic offense of failure to wear a seat belt. During a search incident to appellee Dennis Vincent West's arrest for a seat belt violation, a police officer discovered marijuana on appellee's person. As a result, appellee was charged with possession of marijuana.1
