¶ 1. Appellant Randy Patton was indicted by a Sunflower County grand jury for capital rape. Patton initially pled not guilty to the crime charged. However, on June 13, 1996, Patton withdrew his plea of not guilty and pled guilty to the lesser included offense of sexual battery.
