Appellant Deborah Diaz had custody of Gregory Montenegro, her son by respondent Alex Montenegro, from the day Gregory was born. Alex,1 however, sought custody vigorously and repeatedly. On Alex's third application, when Gregory was five years old, the trial court awarded him custody of Gregory. It reasoned that this change was in Gregory's best interest...
