This matter is before the Court on remand from the United States Court of Appeals for the Fifth Circuit dated February 1, 2000. The Fifth Circuit has remanded this case for determination of "whether the untimely filing of the Notices of Appeal was due to excusable neglect under Pioneer Inv. Services Co. v. Brunswick Associates Ltd. Partnership, 507 U.S. 380
