OPINION

DON BURGESS, Justice.

Following a trial to the bench, Dalton B. Stewart was convicted of theft and sentenced by the trial court to two years in a state jail facility. The sentence was suspended and community supervision was granted for a period of five years, confinement in the Montgomery County Jail for a period of ten days was imposed as a condition of community supervision, a $1,000 fine was assessed, and Stewart was ordered to perform 400 hours...
